New policy withdrawals
bilateral applications Rose
 
 
As from 1 January 2019 we will credit the withdrawals of bilateral rose applications with 75% of the costs for the DUS-test. We will do this for withdrawals which have been made after the final application date of Rose. 

Naktuinbouw is executing DUS-tests for plant breeder’s rights at the request of other UPOV-member states, e.g. for the crop Rose. This happens only on the basis of bilateral agreements with those UPOV members. 

Withdrawal of applications of Rose before the start of the trial
We notice in practice that submitted bilateral applications of Rose are often withdrawn at the moment of the start of the DUS-trial. At that moment we have already done the preparatory work for the trial. Comparing varieties have been settled, reference material has been collected and received and also trial sites have been reserved. 

Also for withdrawals costs have already been made
You will understand that a withdrawal at the time of the start of the DUS-trial leads to undesirable costs. As the number of withdrawals in the species Rose is rather high, considerable costs have been made already by Naktuinbouw. Up till now Naktuinbouw has taken into account these costs.

New policy as from 1 January 2019
As from 1 January 2019 we will credit the withdrawals of bilateral Rose applications with 75% of the costs for the DUS-test. We will do this for withdrawals which have been made after the final application date of Rose. This percentage is in line with the CPVO-policy. We have the opinion that we herewith justify a partly compensation of the costs at the side of Naktuinbouw.
